FMCSA announces plans to begin making next EOBR rule

Despite its recent failures to push through two different requirements for electric on-board recorders, the Federal Motor Carrier Safety Administration announced recently that it plans to continue moving toward a new rule, according to Truckinginfo.

The previous rules, EOBR1 and EOBR2, that were presented last January and August, respectively, were designed to automate Hours of Service reporting.

Hoping to improve the accuracy and timeliness of HOS data, the FMCSA ran into opposition from the drivers concerned that carriers could use the information to harass them into pushing on as long as allowed.

However, The Trucker reports that the FMCSA announced on Monday, February 13, that EOBR3 is definitely on its way. The agency submitted a Supplemental Notice of Proposed Rulemaking, in advance of planned listening sessions where it will attempt to outline the specific concerns about driver harassment.

The specific timeline of these listening sessions remains unclear, but a full schedule should be available soon. The first of the listening sessions should begin by March.

In addition, the FMCSA noted that the Motor Carrier Safety Advisory Committee would be tasked with laying out specific guidelines for the technical specifications of the EOBRs that would be required by the law.



The agency still hopes to require the automated devices.
